1. Acceptance of Terms

By accessing or using SimRev ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms are a legally binding agreement between you and SimRev. By using the Service, you represent that you are at least 13 years old and have the legal capacity to enter into this agreement.

2. Description of Service

SimRev is a platform that allows sim racers to create public racing profiles, build their online presence, connect with the community, and improve their visibility. The Service includes:

• Creation of structured pilot profiles for sim racing
• Public profile pages accessible at simrev.com/username
• Profile customization with blocks (rig setup, personal bests, social links, etc.)
• Analytics tracking (profile views, link clicks)
• Future features may include community discovery, challenges, and other optional platform tools

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access to your account

3.2 Account Termination

We want SimRev to remain useful and safe for the community, so we reserve the right to suspend or terminate your account at any time, for any reason, without notice or liability. You may delete your account at any time through the Service settings.

4. User Content

4.1 Your Content

You retain ownership of content you create and upload to the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating the Service.

4.2 Public Nature of Profiles

Profiles are public by default. That visibility is part of how SimRev helps racers build a presence and be discovered. Any content you add to your profile may be visible to anyone on the internet, so do not include information you do not want to be publicly available.

4.3 Content Restrictions

You agree not to upload or share content that:

• Violates any laws or regulations
• Infringes on intellectual property rights of others
• Contains hate speech, harassment, or discriminatory content
• Contains explicit sexual content or pornography
• Promotes violence or illegal activities
• Contains malware, viruses, or malicious code
• Impersonates another person or entity
• Contains false or misleading information

5. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without permission
• Collect or harvest user information without consent
• Transmit spam, chain letters, or unsolicited communications
• Reverse engineer or attempt to extract source code
• Remove or modify any copyright or proprietary notices

6. Intellectual Property

The Service, including its design, features, code, and content (excluding User Content), is owned by SimRev and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

7. Third-Party Services

The Service may integrate with or link to third-party services such as social platforms, analytics providers, brand websites, or other external tools. Those services are outside our control, and we are not responsible for:

• The availability, accuracy, or content of third-party services
• Third-party privacy practices or terms of service
• Any damages or losses caused by third-party services

8. Sponsorships and Commercial Relationships

SimRev may help users improve visibility with brands or discover sponsorship and commercial opportunities. However, you acknowledge that:

• We do not guarantee any sponsorship deals or commercial opportunities
• We are not a party to any agreements between users and brands
• You are solely responsible for any commercial relationships you enter into
• We are not liable for any disputes, damages, or issues arising from sponsorships
• You must comply with all applicable laws regarding sponsorships and endorsements

9. Disclaimer of Warranties

We care about building a useful platform, but legally we need to be clear: SimRev is offered without guarantees.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE
• SECURITY OR FREEDOM FROM VIRUSES OR HARMFUL CODE
• UNINTERRUPTED OR ERROR-FREE OPERATION

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

To avoid doubt, we are not responsible for losses, disputes, or damages connected to how the Service is used, except where the law does not allow that limitation.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:

• DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
• PERSONAL INJURY OR PROPERTY DAMAGE
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
• STATEMENTS OR CONDUCT OF ANY THIRD PARTY
• ANY OTHER MATTER RELATING TO THE SERVICE

THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THIS MAY NOT APPLY TO YOU.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (WHICH MAY BE ZERO IF THE SERVICE IS FREE).

11. Indemnification

You agree to indemnify, defend, and hold harmless SimRev, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws

12. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

13. Modifications to Service

SimRev will continue evolving, and we reserve the right to:

• Modify, suspend, or discontinue the Service at any time without notice
• Change features, functionality, or pricing
• Impose limits on certain features or restrict access

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in courts of competent jurisdiction, as determined by applicable law.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SimRev regarding the Service and supersede all prior agreements.
